Terms of Service
Effective Date: May 1, 2026
Website: PerfectSentiment.com
Company: Sentimental Brands, LLC
These Terms of Service (“Terms”) govern your access to and use of Perfect Sentiment, including our website, greeting-card video upload and viewing experience, QR-code-based video delivery system, and related services.
By accessing or using Perfect Sentiment, uploading a video, viewing a video, scanning a Perfect Sentiment QR code, purchasing a Perfect Sentiment product, or otherwise using the service, you agree to these Terms.
If you purchased a Perfect Sentiment card before reviewing these Terms and do not agree to them, you may request reimbursement under the terms described below.
If you do not agree to these Terms, do not use Perfect Sentiment.
1. What Perfect Sentiment Provides
Perfect Sentiment allows a sender to attach a personal video message to a physical greeting card. The sender scans the QR code inside the card, uploads a video, finalizes it, and gives the card to the recipient. The recipient scans the QR code inside the card to view the video.
No account is required to upload or view a video.
Perfect Sentiment is intended to make greeting cards more personal by combining a physical card with a private video-message experience.
2. Eligibility and Use of the Service
You may use Perfect Sentiment only if you are legally able to enter into these Terms and comply with applicable law.
If you use Perfect Sentiment on behalf of another person, business, organization, or entity, you represent that you have authority to do so.
Perfect Sentiment is not intended for unlawful, abusive, exploitative, harassing, threatening, defamatory, invasive, obscene, or otherwise improper use.
3. No Account Required
Perfect Sentiment does not require an account for the standard upload or viewing experience.
Because no account is required, access to a video is controlled primarily through the card, QR code, related URL, and any optional viewing password selected by the sender.
You are responsible for keeping those access methods secure.
4. Sender Responsibilities
The sender is responsible for:
- creating or selecting the video to upload;
- ensuring they have the right to upload and share the video;
- ensuring the video is appropriate for the intended recipient;
- reviewing the video before finalizing it;
- deciding whether to add an optional viewing password;
- keeping a copy of the original video if long-term preservation is important;
- maintaining care and control over the card, QR code, URL, and viewing password.
By uploading a video, you represent that you have all rights, permissions, and consents needed to upload, store, display, transmit, and share that video through Perfect Sentiment.
5. User Content
“User Content” means any video, image, audio, text, message, file, or other content uploaded, submitted, transmitted, or made available through Perfect Sentiment.
You retain ownership of your User Content. Perfect Sentiment does not claim ownership of your uploaded video.
However, by uploading User Content, you grant Perfect Sentiment a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, reproduce, adapt for technical purposes, and make the User Content available as necessary to provide, operate, secure, troubleshoot, and improve the Perfect Sentiment service.
This license exists only for the purposes of operating and protecting the service and fulfilling the card/video experience.
6. Prohibited Content and Conduct
You may not upload, submit, transmit, or use Perfect Sentiment in connection with content that:
- violates any law or regulation;
- infringes another person’s copyright, trademark, privacy, publicity, or other rights;
- includes content you do not have permission to share;
- is threatening, abusive, harassing, hateful, exploitative, or defamatory;
- includes sexual content involving minors or any exploitative content;
- encourages self-harm, violence, abuse, or illegal conduct;
- contains malware, spyware, malicious code, or attempts to interfere with the service;
- is intended to impersonate, deceive, defraud, or mislead;
- invades another person’s privacy;
- is otherwise inappropriate for the service.
You may not attempt to:
- bypass access controls;
- guess, scrape, enumerate, or abuse QR-code URLs or tokens;
- interfere with upload, viewing, hosting, security, or deletion systems;
- reverse engineer or misuse the service;
- use automated systems to abuse the service;
- overload, probe, scan, or attack the site or related infrastructure.
We may remove, disable, block, or restrict access to any content or card/video experience if we believe it violates these Terms, creates legal or security risk, or may harm Perfect Sentiment, users, recipients, service providers, or others.
7. Responsibility for Video Content
Perfect Sentiment does not create, select, approve, endorse, or control the content of videos uploaded by users.
The sender is solely responsible for the content of any video uploaded through Perfect Sentiment, including any images, voices, statements, music, personal information, private information, third-party content, or other material included in the video.
By uploading a video, the sender represents that they have the right to upload and share the video and that the video does not violate these Terms, applicable law, or the rights of any other person.
Perfect Sentiment is not responsible for the accuracy, legality, appropriateness, privacy implications, emotional impact, or consequences of any user-uploaded video, except to the extent required by applicable law.
We may remove, disable, or restrict access to any video if we believe it violates these Terms, creates legal or security risk, or may harm Perfect Sentiment, users, recipients, service providers, or others.
8. Care and Control of the Card, QR Code, URL, and Password
Each Perfect Sentiment card contains a QR code and related URL that provide access to the associated video experience.
The sender is responsible for the care and control of the card, QR code, URL, and any optional viewing password.
Anyone who has access to the card, QR code, URL, or viewing password may be able to access the video. This is especially important when a video contains personal, sensitive, private, intimate, or emotionally significant content.
Perfect Sentiment is not responsible for unauthorized access caused by circumstances outside our control, including lost, stolen, copied, photographed, forwarded, posted, shared, or mishandled cards, QR codes, URLs, downloaded videos, or viewing passwords.
Senders should use the optional viewing password when the video is especially personal and should avoid uploading anything they would not want accessed if the card, QR code, URL, or password were shared beyond the intended recipient.
9. Optional Viewing Password
After finalizing a video, the sender may choose to add an optional viewing password.
If a viewing password is added, the recipient must enter that password before watching the video.
Perfect Sentiment cannot recover forgotten passwords. If you add a viewing password, choose something you can share and remember.
The optional viewing password adds a layer of protection, but no online system can guarantee absolute privacy or security.
10. Upload, Review, and Finalization
The sender may upload a video and review it before finalizing it.
Once a video is finalized, it becomes the video associated with that card’s viewing experience, subject to the availability period described below.
Perfect Sentiment may provide a limited review/replacement window before finalization, subject to system rules, technical limits, or other restrictions. Available options may change as the service evolves.
The sender is responsible for reviewing the uploaded video before finalizing it.
11. Video Availability and Deletion
Unless otherwise stated, videos remain available for six months after the sender finalizes the video.
Perfect Sentiment is not permanent video storage.
Senders should keep the original video if they want to preserve it permanently.
Recipients should download the video before it expires if they want to keep a copy.
After the availability period ends, the video may be deleted, disabled, or made unavailable. Perfect Sentiment may retain limited technical, security, audit, operational, or legal records after a video is deleted or made unavailable.
12. Downloads
Perfect Sentiment may allow recipients or authorized viewers to download a video before it expires.
Once a video is downloaded, Perfect Sentiment cannot control how the downloaded file is stored, shared, copied, edited, posted, deleted, or used by the person who downloaded it.
Senders should consider this before uploading personal or sensitive content.
13. Privacy
Your use of Perfect Sentiment is also governed by our Privacy Policy, which explains what information we collect, how we use it, how long we keep it, and what choices are available.
The Privacy Policy is incorporated into these Terms by reference.
14. Third-Party Service Providers
Perfect Sentiment may use third-party service providers for website hosting, video storage, video processing, playback, security, performance, email, analytics, diagnostics, or other operational needs.
We are not responsible for failures, outages, delays, errors, interruptions, or security incidents caused by third-party services, except to the extent required by applicable law.
15. Purchases, Pricing, Taxes, Shipping, and Refunds
Perfect Sentiment products may be sold directly or through third-party marketplaces, retailers, distributors, or other sales channels.
Prices, taxes, shipping terms, refund policies, return policies, and promotional offers may vary depending on where and how a product is purchased.
If you purchase through a third-party marketplace, retailer, or distributor, that seller’s purchase, shipping, refund, and return terms may also apply.
Perfect Sentiment may update product offerings, pricing, availability, features, or promotional terms at any time.
Reimbursement if Terms Are Not Accepted
If you purchased a Perfect Sentiment card before reviewing these Terms and decide that you do not agree to them, you may request reimbursement for the purchase price of the card.
To request reimbursement, you must provide proof of purchase and the card’s QR-code or associated URL, or other information needed for us to identify and deactivate the card.
You do not need to return the physical card. However, if reimbursement is issued, the card’s video functionality will be deactivated and the card may no longer be used to upload, finalize, view, or access a video.
Reimbursement is not available if the card’s video has already been finalized and viewed by the recipient or another viewer. A single sender review of the uploaded video before finalization does not, by itself, prevent reimbursement.
This reimbursement option applies only when the request is based on non-acceptance of these Terms. Other refunds, returns, or purchase issues may be governed by the seller’s applicable return or refund policy.
16. Product and Service Changes
We may modify, suspend, discontinue, replace, or update any part of Perfect Sentiment at any time, including website features, upload flows, video hosting methods, viewing features, password options, retention periods for future products, technical requirements, or supported devices.
Changes will not necessarily affect videos already finalized under an existing availability period, but we may make changes when needed for security, legal compliance, service integrity, technical limitations, or business reasons.
17. Device, Browser, and Network Requirements
Perfect Sentiment is designed to work on common modern smartphones, browsers, and internet connections.
We do not guarantee that every device, browser, camera app, QR scanner, network, firewall, security filter, content blocker, VPN, or corporate network will support or allow access to the service.
Some business, school, or managed networks may block or warn about websites, QR-code links, video playback, uploads, or newly categorized domains. Perfect Sentiment is not responsible for network filtering, device restrictions, browser behavior, or third-party security policies outside our control.
18. Intellectual Property
Perfect Sentiment, including its name, logo, designs, website, software, workflows, QR-code/video delivery system, text, graphics, user interface, and related materials, is owned by Perfect Sentiment or its licensors and is protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, reverse engineer, scrape, resell, rebrand, or create derivative works from Perfect Sentiment except as expressly permitted in writing.
You may not use Perfect Sentiment’s name, logo, brand, designs, software, card system, QR-code system, video delivery system, or related materials in a way that suggests sponsorship, endorsement, partnership, licensing, or affiliation without written permission.
19. Feedback
If you send us ideas, comments, suggestions, or feedback, you grant Perfect Sentiment permission to use that feedback without restriction or compensation.
We are not obligated to keep feedback confidential unless we have agreed otherwise in writing.
20. No Professional Advice
Perfect Sentiment is a greeting-card and video-message hosting and delivery service. It does not provide legal, medical, financial, therapeutic, security, or other professional advice.
Any information provided on the site is for general informational purposes only.
21. Disclaimers
Perfect Sentiment is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, uninterrupted operation, error-free operation, data preservation, video quality, compatibility, or security.
We do not guarantee that:
- the service will always be available;
- uploads or playback will always work on every device or network;
- videos will never be accessed by an unintended person;
- QR codes will always scan in every environment;
- third-party service providers will operate without interruption;
- uploaded videos will be permanently preserved;
- downloaded videos will remain private;
- all errors or defects will be corrected.
Some jurisdictions do not allow certain disclaimers, so some of these disclaimers may not apply to you.
22. Limitation of Liability
To the maximum extent permitted by applicable law, Perfect Sentiment and its owners, officers, employees, contractors, agents, affiliates, licensors, service providers, successors, and assigns will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, emotional-distress, reputational, loss-of-data, loss-of-content, lost-profit, lost-opportunity, or similar damages arising out of or related to Perfect Sentiment, any card, QR code, URL, video, upload, viewing experience, password, download, service interruption, deletion, expiration, unauthorized access, or use of the service.
To the maximum extent permitted by applicable law, Perfect Sentiment’s total liability for any claim arising out of or related to a Perfect Sentiment product, video, upload, viewing experience, or use of the service will not exceed the amount paid for the specific card or product giving rise to the claim.
If no amount was paid directly to Perfect Sentiment for the specific product or service giving rise to the claim, Perfect Sentiment’s total liability will not exceed $15.00.
These limitations apply regardless of the legal theory, including contract, tort, negligence, strict liability, warranty, statute, or otherwise, and even if a remedy fails its essential purpose.
Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you. In those jurisdictions, liability is limited to the greatest extent permitted by law.
23. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Perfect Sentiment and its owners, officers, employees, contractors, agents, affiliates, licensors, service providers, successors, and assigns from and against any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use of Perfect Sentiment;
- your uploaded video or other User Content;
- your violation of these Terms;
- your violation of any law or regulation;
- your infringement or violation of another person’s rights;
- your failure to obtain necessary rights, permissions, or consents;
- your sharing, loss, misuse, posting, photographing, forwarding, or mishandling of a card, QR code, URL, viewing password, or downloaded video.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with us.
24. Dispute Resolution; Informal Resolution First
Before filing a claim, either party must first attempt to resolve the dispute informally.
If you have a concern, contact us through our Contact page.
The parties will make a good-faith effort to resolve the dispute informally for at least 30 days before either party starts arbitration or court proceedings, except where immediate action is needed to protect intellectual property, security, privacy, or legal rights.
25. Binding Arbitration
To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, Perfect Sentiment, any card, QR code, URL, video, upload, viewing experience, password, download, purchase, or use of the service will be resolved by binding arbitration rather than in court.
The parties will attempt in good faith to agree on a reputable neutral arbitration provider and applicable consumer arbitration rules. If the parties cannot agree on an arbitration provider within a reasonable time after arbitration is demanded, either party may ask a court of competent jurisdiction to appoint an arbitrator or designate an appropriate arbitration forum, subject to applicable law.
The arbitration will take place in Marion County, Indiana, unless the parties agree otherwise or applicable law requires another location or remote proceeding.
The arbitrator will have authority to resolve disputes about interpretation, applicability, enforceability, and formation of this arbitration agreement, except that any dispute about the class-action waiver below will be decided by a court of competent jurisdiction unless applicable law allows otherwise.
Judgment on the arbitration award may be entered in any court with jurisdiction.
This arbitration provision does not prevent either party from seeking relief in small claims court if the claim qualifies and remains in small claims court.
26. Class Action Waiver
To the maximum extent permitted by law, you and Perfect Sentiment agree that each may bring claims against the other only in an individual capacity and not as a plaintiff, claimant, class member, or representative in any class action, collective action, representative action, private attorney general action, mass arbitration, or other consolidated proceeding.
The arbitrator may not consolidate claims of multiple persons or preside over any class, collective, representative, or consolidated proceeding unless all parties agree in writing.
If this class-action waiver is found unenforceable as to a particular claim or request for relief, then that claim or request for relief may be severed and handled in court to the extent required by law, while all remaining claims remain subject to arbitration where permitted.
27. Exceptions to Arbitration
Nothing in these Terms prevents either party from seeking temporary, preliminary, or permanent injunctive or equitable relief in court to protect intellectual property rights, confidential information, security, privacy, trade secrets, system integrity, or unauthorized access.
Nothing in these Terms prevents claims from being brought in small claims court if they qualify and remain there.
28. Governing Law and Venue
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules, except where federal law applies or where applicable consumer-protection law requires otherwise.
For any dispute not subject to arbitration, the parties agree to the exclusive jurisdiction and venue of the state and federal courts located in Marion County, Indiana, except where applicable law requires otherwise.
You and Perfect Sentiment waive any objection to personal jurisdiction or venue in those courts to the maximum extent permitted by law.
29. Changes to These Terms
We may update these Terms from time to time.
When we update them, we will revise the effective date above. The updated Terms will apply to use of Perfect Sentiment after the effective date.
If a change materially affects an already-finalized video, we will handle that situation in a commercially reasonable manner, subject to security, legal, technical, and operational needs.
30. Termination or Restriction of Access
We may suspend, restrict, disable, delete, or terminate access to Perfect Sentiment, a video, card code, upload, viewing page, or related feature if we believe:
- these Terms have been violated;
- the service is being abused;
- a video or use creates legal, security, privacy, or operational risk;
- required by law or legal process;
- necessary to protect Perfect Sentiment, users, recipients, service providers, or others.
31. Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent.
Perfect Sentiment may assign or transfer these Terms, the service, the website, intellectual property, assets, rights, obligations, or related business operations in connection with a merger, acquisition, sale, reorganization, licensing arrangement, financing, transfer, or other business transaction.
32. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified to the minimum extent necessary to make it valid and enforceable.
The remaining provisions will remain in full force and effect.
If any portion of the arbitration agreement or class-action waiver is found unenforceable, it will be handled as stated in those sections and to the maximum extent permitted by applicable law.
33. No Waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later.
Any waiver must be in writing to be effective.
34. Entire Agreement
These Terms, together with the Privacy Policy and any purchase terms, product terms, or written agreements that expressly apply, make up the entire agreement between you and Perfect Sentiment regarding use of the service.
35. Contact
Please use our Contact page for any questions or concerns relating to these Terms.
